Acceptable Use Policy

1. Scope
This Acceptable Use Policy (“AUP”) applies to all users of the Precon platform, including all websites, applications, APIs, and services operated by Precon, Inc. This AUP is incorporated into and forms part of our Terms of Service. Capitalized terms not defined here have the meanings given in the Terms.
2. General Prohibited Conduct
You may not use the Service to:
- Violate any applicable law, regulation, or third-party rights
- Harass, threaten, defame, or discriminate against any person
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity
- Gain or attempt to gain unauthorized access to the Service, other users' accounts, or any systems or networks connected to the Service
- Interfere with or disrupt the Service, servers, or networks, including through denial-of-service attacks or excessive automated requests
- Introduce malware, viruses, trojans, worms, or other harmful code
- Circumvent, disable, or interfere with any security features or access controls of the Service
3. Data and Content Restrictions
You may not:
- Upload content that you do not have the legal right to transmit, including content that infringes intellectual property rights
- Upload files containing malicious code or exploits
- Upload regulated data (e.g., HIPAA-protected health information, classified government documents) without appropriate authorization and safeguards
- Share your account credentials or allow unauthorized persons to access your account
- Attempt to access, collect, or store personal data of other users without their explicit consent
4. AI Usage Restrictions
You may not:
- Use AI Outputs as the sole basis for safety-critical decisions without independent human verification by qualified professionals
- Use the Service to generate content for the purpose of building or improving a competing product or service
- Systematically extract, scrape, or harvest AI Outputs for the purpose of training, fine-tuning, or evaluating other artificial intelligence or machine learning models
- Use AI Outputs in ways that violate applicable AI regulations, including the EU AI Act
- Represent AI-generated content as human-generated in contexts where disclosure of AI involvement is required by law
- Use the Service to generate deceptive, misleading, or fraudulent content
5. Rate Limits and Automated Access
To ensure fair use and platform stability for all users, the following restrictions apply:
- You may not exceed the rate limits, API call quotas, storage limits, or other usage thresholds applicable to your subscription plan. Current limits are published in the platform documentation and may be updated from time to time
- Automated access to the Service (including via scripts, bots, crawlers, or programmatic tools) is permitted only through Precon's official APIs and in compliance with published API documentation and rate limits
- You may not use automated means to bypass rate limits, create multiple accounts to circumvent usage restrictions, or artificially inflate usage metrics
- You may not use the Service in a manner that degrades performance for other users, including sending excessively large files, submitting an unreasonable number of concurrent processing requests, or deliberately triggering resource-intensive operations
- Precon reserves the right to throttle or temporarily suspend access to protect platform stability, with notice where practicable
6. Competitive Restrictions
You may not:
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or algorithms of the Service
- Use the Service for competitive benchmarking or competitive intelligence purposes
- Systematically scrape, copy, or extract data from the Service by automated means
- Build a product or service that substantially replicates the features or functionality of the Service using data or insights derived from Precon
- Resell, sublicense, or redistribute access to the Service without written authorization from Precon
7. Email Integration Restrictions
If you use the email integration features, you additionally may not:
- Connect email accounts that you are not authorized to access
- Use email intelligence features for harassment, unauthorized surveillance, or stalking
- Bulk-extract contact data from email intelligence for the purpose of sending unsolicited commercial communications (spam)
- Use email integration to access email accounts of persons who have not consented to such access
8. Construction-Specific Restrictions
Given the professional nature of construction work, you may not:
- Submit AI-generated takeoffs, estimates, or bid proposals as certified professional work product without review and approval by an appropriately licensed or qualified professional
- Represent AI-generated contract analysis, clause recommendations, or legal playbook outputs as formal legal advice to third parties
- Use AI-generated safety or compliance analyses as a substitute for inspections or assessments required by applicable building codes or safety regulations
9. Enforcement
Precon reserves the right, but has no obligation, to monitor use of the Service for compliance with this AUP. If we determine that a violation has occurred, we may:
- Issue a warning
- Temporarily suspend access to the Service
- Permanently terminate your account
- Report illegal activity to appropriate law enforcement authorities
- Take any other action we deem necessary to protect the Service, our users, or third parties
We will use reasonable efforts to provide notice before enforcement action, except where immediate action is necessary to protect the Service or other users.
10. Reporting Violations
If you believe a user is violating this AUP, please report it to abuse@precon.com.
11. Changes
We may update this AUP as the Service evolves or as laws change. For material changes, we will provide at least thirty (30) days' advance notice via the email associated with your account. Non-material changes (such as clarifications) take effect when posted at /legal/acceptable-use with a new effective date. Continued use of the Service after the applicable notice period constitutes acceptance of the updated AUP.
